Yes, with the solidification and multiplication of the rebate entities, such
as ETO and others, it would be nice to see our industry group focusing on
dealer specific issues, such as group health insurance and boiler plate
contracts.  

 

MOST IMPORTANTLY, I would love to see professional representation at the
Rebate agencies, the PUC advocating pro solar interconnection guidelines (we
are getting run over by the utilities), and for electrical inspector issues.


 

The local SEIA chapter, with a subcommittee on a specific issue is seemingly
the way to go. 

 

CONTRACT PROVISIONS

      

INTEREST CHARGES:

Here is a succinct note from my bookkeeper on this issue for Oregon,

 

"the attached information (HB2871, which the Gov. signed) indicates that the
limit on consumer credit prior to the 2007 legislative session was 12%.
However, the check cashing industry was getting away with rates up to 500%
due to the short term nature of their loans and the fees they tacked on. So,
in 2007, the legislature capped the limit on consumer credit at 36%. Fees
must be included when calculating interest and it must be simple, not
compound interest.

 

It appears that we could legally charge 36% but then again, one would want
to ask, "What are we trying to accomplish?"  I think the logic is that it
should motivate the customer to pay on time and cover our cost of capital if
they don't pay on a timely basis. Would 12% or 18% do the same thing as 36%
and leave a better impression with the customer?"

There have been some very positive responses to my email gripe about not
having the benefit of a trade organization to help advise us on things like
standard contract clauses and things to watch out for related to liability,
payments, and documentating system performance.

 

However, most of you are concerned that the general public can read these
emails and they do not want potential clients reading these since they could
involve future legal issues.

 

For anyone wanting to take part in this first attempt to come up with some
"common sense" contract guidelines, if you will send your suggestions and
any related "stories" about what caused you to add these contract or
proposal items, I will put them into some kind of standardized format that
can be edited and copied by you. When this is finished, I will send this
document in both Word and PDF format in private email attachment to everyone
who helped. 

 

Of course you may still want an attorney to review, but at least you will
have a bunch of clauses that you would not think of including in your
proposals as others doing the same type work learned the hard way.
