Even though it's not a code requirement, you just want to be careful that the local AHJ doesn't decide to write it into their local code just to clear it up for themselves.  

I'm attaching the new language adopted by the NYC electrical advisory board stating our new U.L. requirement.  Although many of you aren't near NY city, I'd encourage you to make sure something like this doesn't start cascading out to jurisdictions all across the country.

You never know.

In this matter I have never refuted the Cities right to require the switch.
I can not see that it constitutes an abuse of discretion trespassing on the
States interest in promoting renewable energy systems. I simple reject the
justification that it is "required by the Code" and ask for a basic
explanation of how the requirement promotes the health and safety of the
citizens of the City.

At the same time I don't like the switch so I am trying to pressure them to
drop the requirement by showing that other jurisdictions have done away with
it.

Mark,
If the City of Berkeley requires the switch, erroneously claiming the it is
"required by the code", can you simply use this to your advantage by getting
the city powers to agree that if either a) you can prove it's not required,
or b) they can't prove it is, they will drop the requirement?
