Architectural bureaucracy [RE-wrenches]

Friends:

I am doing a commercial PV installation in a downtown area.  The project is 
in a "Historical District."  The junior planner reviewing the permit 
application is making hints that the panels can not be allowed to be seen 
from the street.  My research indicates that if it is anticipated that any 
portion of the modules can be seen from the street, the project needs to be 
reviewed by the Architectural Review Board and the "Cultural Heritage 
Commission" (or some similarly named bodies), at about $1,000.00 per review.

Can a city planner mandate this?  Is there any state law or case law that 
protects a citizens right to collect sunlight without undue governmental 
obstruction?

I appreciate any input on this.
