If you just have that one inverter, then go with the 40A breaker, the surge will not be an issue as the breaker is designed for that. The inspector may want to see a bolt-on/down breaker or some type of retainer and this can be a hassle. W/o seeing what you have to work w/and you want that 60A for some reason then simply do a tap between the Meter and the 200A Main. Put a 60A fused disco in there and it's a done deal for under a $100, including taps. Use a Burndy or Polaris.
