the taxpayer for its intended purpose. Four things must ordinarily have happened for <BR>

installation on site must have been completed, although contractor personnel can <BR>

tasks like painting and attending to punchlist items. <BR>
</FONT><FONT FACE="Times, Times New Roman">·</FONT><FONT FACE="Arial"> The taxpayer must have taken legal title and control of the equipment. <BR>
</FONT><FONT FACE="Times, Times New Roman">·</FONT><FONT FACE="Arial"> The taxpayer must have the licenses and permits needed to operate it. <BR>
</FONT><FONT FACE="Times, Times New Roman">·</FONT><FONT FACE="Arial"> Pre-operational tests must have demonstrated that the equipment can serve its <BR>
intended function. (Other testing to determine whether the equipment can <BR>
operate at the design capacity and to identify and eliminate defects can occur <BR>
after the equipment is in service.) <BR>

Basically, anything that Kirpal and the utility can do to clarify that the system is placed into service in 2009 will serve the customer’s interest. We are thinking of having the power company hold off until after the new year so that the customer can get the 2009 tax credits instead of the 2008 credits.......<BR>
The question is does the system get commissioned once it is inspected or once the power company gets the new meter installed so that the system can actually be turned on.....<BR>
