Doug's is right on this. It is legislated in the net metering law. However 
don't get too comfortable--what can be legislated can be unlegislated!

One other thing- I checked with my TOU customers. As far as we can tell they 
do not pay an extra $5/ month.  The actual service charged ranged between 5 
an 6 dollars per month. This pretty much in line with non TOU charges. The 
one time $277 is something to consider in the overall economic picture.
